Terms of Service.

ByHuman Creators is a verifiable badge for video creators. You sign in with the Google account that owns your YouTube channel, fill out a short disclosure form, sign an attestation, and we mint a public proof page anchored to Bitcoin via OpenTimestamps. Your YouTube description can link to that proof page.

ByHuman is not an AI detector. We do not analyze your video frame-by-frame. The credibility of a Silver badge depends on verified ownership of the YouTube channel, the disclosure you publish under your channel's name, and the immutable timestamp anchored to Bitcoin.

• You're at least 13 years old (or the minimum age in your jurisdiction, whichever is higher).
• You sign in with a Google account that owns the YouTube channel you want to stamp videos for.
• You're currently on our test users allowlist (alpha period). Public verification is coming.

• The video is yours. You only stamp videos posted by the channel you authenticated. We re-verify ownership server-side at mint time.
• The file matches the YouTube video.The video file you upload to ByHuman for hashing is the same content (your master) that's published at the YouTube URL you provide. We don't verify byte-equality (impossible because YouTube re-encodes uploads) — your attestation links the master to the public video. Stamping a different file misrepresents the proof to viewers and is grounds for revocation.
• The disclosure is accurate. Your answers about voice, script, B-roll, and AI tool use reflect how the video was actually made.
• You understand the badge is public. The proof page renders publicly at getbyhuman.com/v/<slug> and is intentionally indexable.
• You accept revocation consequences. If a badge is later proven to misrepresent the video, ByHuman may publicly revoke it. Repeat or egregious cases lead to channel-wide revocation and a public listing.

Anyone can report a badge they believe misrepresents itself. We review every report. The badge owner gets 7 days to respond before we make a revocation decision. Revoked badges remain on the proof page (replaced with a revocation notice) so the historical record stays visible.

Egregious cases — clear AI-generated content stamped as human-made, stolen channels, or repeated false disclosures — may result in immediate revocation without the 7-day response window.

• Don't stamp videos you don't own.
• Don't lie on the disclosure form.
• Don't abuse the report feature to harass other creators.
• Don't attempt to brute-force, scrape, or otherwise interfere with the service.

The Silver tier is free during the alpha. Gold (live capture + voice-print verification + reputation staking) will be paid when it launches. Pricing for Gold will be communicated and agreed to before any charge takes effect; we'll give existing creators clear notice before launching paid tiers.

ByHuman Creators is in alpha. We don't promise uptime, feature stability, or that any particular badge will remain valid forever. We'll communicate major changes to active creators via email.

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, ByHuman Creators makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that proof pages will remain accessible, that OpenTimestamps will continue to operate, or that Google won't change its OAuth policies in ways that affect the service.

To the maximum extent permitted by law, ByHuman Creators is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue from sponsorships, lost ad monetization, or reputational harm — whether or not we've been advised of the possibility. Our aggregate liability for any direct damages is limited to the greater of (a) $50 USD or (b) what you've paid us in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless ByHuman Creators, its operators, and contributors from and against any third-party claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) the badges you mint, (b) the disclosures or attestations you publish, (c) the videos linked to your badges, or (d) your violation of these Terms or any law.

You and ByHuman Creators agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service will be resolved through binding individual arbitration administered under the rules of the American Arbitration Association. Arbitration will take place in San Francisco, California, unless we mutually agree otherwise.

Class action waiver. You and ByHuman Creators waive any right to participate in a class action, class arbitration, or representative action. Disputes will be resolved on an individual basis.

Either party may bring an action in small-claims court for individual disputes that fall within that court's jurisdiction.

You can stop using ByHuman Creators at any time and request deletion of your account (see the Privacy Policy).

We may suspend or terminate accounts that violate these terms, repeatedly file inaccurate disclosures, or attempt to abuse the service. We'll communicate the reason in writing.

We'll update these terms when the service changes meaningfully. The “Last updated” date at the top changes. For material changes we'll email signed-in creators before they take effect. Continuing to use the service after a change means you accept the updated terms.

These terms are governed by the laws of the United States and the state of California, without regard to conflict-of-law principles.
